Where to File Edina Probate Cases

Edina is in Hennepin County, southwest of Minneapolis. All probate filings for Edina residents go to Hennepin County District Court at the Government Center in downtown Minneapolis. The court operates within the Fourth Judicial District. Edina has a Southdale Regional Center, but that location handles criminal and traffic matters only. It does not handle probate. All estate and will filings must go to the main Government Center location at 300 South Sixth Street.

The City of Edina does not process probate filings. Those go to the county court. If you try to file at Southdale or at any Edina city office, you will be redirected to Minneapolis. Save the trip and go directly to the Government Center for any probate matter.

Document access depends on when records were filed. For probate cases filed on or after July 1, 2015, full public documents are accessible. Cases from July 1, 2005 through June 30, 2015 offer limited access, showing mainly orders and notices. Records filed before 2005 are not online. What Edina Probate Records Contain

Hennepin County probate case files hold the documents created as an estate moves through the court process. A standard estate file typically contains the original petition, the will if one was filed, letters testamentary or letters of administration, an asset inventory, creditor claim notices, accountings, and the final distribution decree. More complex or disputed estates add motions, hearings, and additional court orders to the file.

Guardianship and conservatorship cases have their own document sets. Those include the initial petition, orders from the court, and annual reports submitted by the appointed person each year. Some recent guardianship records have restricted access under state court rules. Public estate records are open once a case is filed and active. Certified copies cost $14 per document. Uncertified copies are generally available at no charge at Hennepin County.

Edina Probate Filing Process

When an Edina resident dies, their estate may need to go through probate at Hennepin County District Court. Whether probate is required depends on the value and type of assets. Under Minnesota Statute 524.3-1201, estates with $75,000 or less in personal property and no real estate can use a small estate affidavit instead of opening a court case. You must wait 30 days after the death before using this process.

Estates that include real property or are larger in value require informal or formal probate. Informal probate proceeds without a court hearing in most situations. Formal probate involves a judge and a scheduled hearing and is used when there are disputes or complex issues. Both types are filed at 300 South Sixth Street in Minneapolis.
