How to Search Carver County Probate Court Records

To search Carver County probate court records online, go to MCRO at publicaccess.courts.state.mn.us. The system is free and open 24 hours a day. Search by party name or case number, then select "Probate or Mental Health" under the case type options to filter results. MCRO shows case summaries and the full register of actions for each case, which lists every document filed and every court order entered.

Documents from cases filed on or after July 1, 2015, are available in MCRO. For cases filed between 2005 and 2015, the system shows orders and judgments but may not have all filed documents. For records from before 2005, contact the court directly at (952) 361-1420. When requesting copies, the Carver County District Court recommends using MCRO first to locate the case before making a copy request. Having the case number ready makes the process go faster.

According to the court's copy request guidance, a request for "all documents" may return far more pages than you need. Use MCRO to find the specific documents you want before submitting a copy request. The court offers plain copies (photocopies or printed electronic files) and certified copies (stamped and sealed by court staff). Important note: if a certified document is stapled, removing the staple means the document is no longer considered certified.

The Carver County District Court holds several types of probate records. Estate administration cases are the most common. When a person dies, probate is the legal process the court uses to transfer their property to heirs and ensure their debts are paid. Guardianship and conservatorship cases are also filed in the probate division. A guardianship appoints someone to make personal decisions for a person who cannot do so. A conservatorship appoints someone to manage another person's finances and property. Both types require annual reports to be filed with the court. If a person's condition changes, the case can be modified or closed by a judge. Determination of descent is used to confirm who inherits property when no formal probate was ever opened. Trust proceedings come before the court when a trust is in dispute or requires judicial supervision.

Filing Fees for Carver County Probate Cases

Carver County follows Minnesota's standard probate fee schedule. The base fee to open an estate, trust, guardianship, or conservatorship is $310, with a law library surcharge added. Check the current total with the court or on the Carver County fee schedule page before you file. Depositing a will for safekeeping without opening full probate costs $27. Filing a motion during an open case costs $100. Certified copies are $14 each. Uncertified copies are free.

If you cannot pay the filing fee, ask the court about a fee waiver. The court has forms for this purpose, and eligibility depends on income. Fee waivers do not cover all fees in every situation, so ask staff what the waiver covers before relying on it.

Opening a Probate Case in Carver County

To start a probate case in Carver County, gather the original will if one exists, a certified copy of the death certificate, and a general list of assets and debts. Forms are free from the Minnesota courts probate forms library. The library includes forms for informal and formal probate, guardianship, conservatorship, and small estate affidavits.

Most straightforward estates use informal probate. No hearing is required. The personal representative files the paperwork, and the court issues letters testamentary or letters of administration. For contested situations, formal probate requires a hearing before a judge. Both types are governed by Minnesota Statutes Chapter 524.

For small estates with under $75,000 in personal property and no real estate, heirs may be able to collect assets using the Small Estate Affidavit under Minnesota Statute 524.3-1201, as long as 30 or more days have passed since the date of death. Creditors have four months from the published creditor notice, or one year from the date of death, to file claims under Statute 524.3-803. Probate must be started within three years of death under Statute 524.3-108.
