What Is in a Freeborn County Probate File

Probate files in Freeborn County contain the legal documents that govern how a deceased person's property is transferred to heirs. A typical estate file has the petition to open the estate, the will (if one exists), a notice to creditors, an inventory of assets, any claims filed by creditors, accountings prepared by the personal representative, and the final court order closing the estate. Letters of authority issued to the personal representative are also part of the file and are often needed by banks, title companies, and other parties.

Guardianship and conservatorship cases document court supervision of people who cannot manage their own affairs. These files include the original petition, medical evaluations, the court order appointing a guardian or conservator, and annual reports submitted to the court. Determination of descent cases, which confirm who inherits property without a full probate, are also filed in the probate division.

Freeborn County Probate Process

Estates in Freeborn County go through either informal or formal probate. Informal probate skips the court hearing. The personal representative files the required documents, and the court issues letters of authority. This works when the will is not contested and heirs agree on who serves as personal representative. Most estates qualify for informal probate.

Formal probate requires at least one hearing before a judge. This is necessary when there is a disputed will, heirs cannot agree on the personal representative, or the estate has complicated issues that need a court ruling. Minnesota Statutes Chapter 524 governs both types of proceedings.

Small estates may skip probate entirely. Under Minnesota Statute 524.3-1201, if personal property is under $75,000, there is no real estate, and 30 days have passed since death, heirs can collect assets using the small estate affidavit (PRO201/202). Under Minnesota Statute 524.3-803, creditors have four months from notice or one year from death to file claims. Probate must start within three years of death under Minnesota Statute 524.3-108.
