Starting a Probate Case in Isanti County

Isanti County uses the same two-path probate system as all Minnesota counties. Informal probate handles straightforward estates where the will is not disputed and heirs agree on who serves as personal representative. No hearing is required. The personal representative files the right documents, and the court issues letters of authority. This is how most estates proceed.

Formal probate is needed when there is a will contest, heirs cannot agree, or the court must rule on a specific dispute. At least one hearing before a judge is required. Both informal and formal probate are governed by Minnesota Statutes Chapter 524.

Some Isanti County estates qualify for the small estate process. Under Minnesota Statute 524.3-1201, if total personal property is under $75,000, there is no real estate, and at least 30 days have passed since death, an heir can use the small estate affidavit (PRO201/202) to collect assets without opening probate. Creditors have four months from the published notice, or one year from death, to file claims per Minnesota Statute 524.3-803. Probate must begin within three years of death under Minnesota Statute 524.3-108. The probate help page and forms library are good starting points for anyone new to this process.
