What Otter Tail County Probate Records Contain

An estate file in Otter Tail County generally starts with a petition or application to open the estate, along with any will submitted at the time. A notice to creditors is published, and all creditor claims received during the claim period are added to the file. The personal representative then prepares and files an inventory of estate assets. Final accounts and a proposed distribution are filed as the estate winds down. A closing decree or order from the court marks the end of the case.

Guardianship and conservatorship files are part of the Otter Tail County probate court's records as well. These ongoing files include the original petition, medical or evaluator reports submitted to support the appointment, the court's order naming the guardian or conservator, and annual reports filed going forward. These cases remain open and continue to generate new filings as long as the protected person is alive and the appointment remains in place.

Determination of descent filings, trust cases, and will deposit records also fall within the probate division's jurisdiction. Will deposits are records of wills filed with the court for safekeeping without opening a full estate proceeding. These are simple filings but do appear in the court's records and can be searched through MCRO or in person.

Note: Certain documents within a probate file, such as medical reports in a guardianship case, may be restricted. Ask court staff which parts of a particular file are open to public review.

Starting a Probate Case in Otter Tail County

Informal probate is the most common way to open an estate in Otter Tail County. There is no court hearing required. The personal representative files the application and supporting papers with the court, and the court issues letters of authority without a scheduled hearing date. This works when the will is not contested and all parties agree on who should serve as personal representative.

Formal probate requires a hearing and is used when there are disputes over the will, conflicts about the personal representative, or other issues that need a judge to decide. Both informal and formal probate are governed by Minnesota Statutes Chapter 524. All forms needed are available at the Minnesota probate forms library. The Minnesota probate help page is a useful guide for anyone new to the process.

Small estates with personal property under $75,000 and no real estate may qualify for the Affidavit for Collection of Personal Property (PRO201/202) under Minnesota Statute 524.3-1201 if 30 days have passed since death. Creditors have four months from published notice or one year from death to file claims under Minnesota Statute 524.3-803. Probate must be opened within three years of death under Minnesota Statute 524.3-108.

The Minnesota courts also have an eFiling system for submitting documents electronically. Most probate forms are compatible with the system. See the eFiling rules under Rule 14 of the General Rules of Practice for guidance.
