Searching Pennington County Probate Records

Minnesota Court Records Online (MCRO) is the best place to start when searching for Pennington County probate records. Pennington County Probate Records Content

A probate estate file in Pennington County starts with the opening petition or application, any will submitted with it, and creditor notice documentation. The file grows over time as annual reports are submitted and any changes to the appointment are ordered by the court.

Trust cases, determination of descent filings, and will deposit records round out what the court holds under its probate jurisdiction. A will deposit is a simple filing that puts a will on record with the court without opening a full estate case. It does not create a probate proceeding, but the will becomes part of the court's permanent records.

How to Start a Probate Case in Pennington County

Most estates in Pennington County go through informal probate, which does not require a court hearing. Estates with personal property under $75,000 and no real estate may use the small estate affidavit (PRO201/202) under Minnesota Statute 524.3-1201 if at least 30 days have passed since death. Creditors must file claims within four months of creditor notice or one year from death under Minnesota Statute 524.3-803. Probate must be started within three years of death per Minnesota Statute 524.3-108.
