Fillmore County Probate Court Record Types

Probate records in Fillmore County document the legal transfer of property after a person's death and proceedings for people who need help managing their own affairs. The main types of cases filed in the probate division include estate administration (both informal and formal), will probate and will contests, guardianship and conservatorship proceedings, trust cases, determination of descent, and small estate matters.

A standard estate file contains the petition, the will (if one exists), a notice to creditors, an inventory of the deceased person's assets, any creditor claims, accountings prepared by the personal representative, and the final order closing the estate. Guardianship files add medical evaluations and annual reports. Determination of descent cases let courts confirm who inherits property without a full probate process.

Some documents in a probate file may be sealed by court order. If you cannot find a particular document in MCRO, ask the court clerk whether it is restricted and what you need to do to access it.

How Probate Works in Fillmore County

When a person dies with property in Fillmore County, the estate may need to go through probate at the district court. Informal probate is the most common path for straightforward estates. The personal representative files paperwork, the court issues letters of authority, and the case moves forward without a hearing. This works when there is no dispute among heirs and no complicated assets.

Formal probate requires a court hearing. This is the right process when heirs disagree, there is a will contest, or the court needs to make a specific ruling on an issue in the estate. Minnesota Statutes Chapter 524 governs both types of proceedings and outlines the duties of personal representatives, the rights of creditors, and how distributions are handled.

If the total personal property is under $75,000, there is no real estate, and at least 30 days have passed since death, you may use the small estate affidavit (PRO201/202) under Minnesota Statute 524.3-1201. Creditors have four months from notice publication, or one year from death, to file claims under Minnesota Statute 524.3-803. Probate must start within three years of death per Minnesota Statute 524.3-108. The probate help page and probate forms library are good places to start.
