Search by party name or case number and select "Probate or Mental Health" as the case type to limit results to estate and guardianship matters. What Houston County Probate Files Contain

Opening a Probate Case in Houston County
Most Houston County estates use informal probate, which does not require a court hearing. The personal representative files the petition and related documents, and the court issues letters of authority. This path works when there is no will dispute and heirs are in agreement. It is faster and less costly than formal probate.
Formal probate is needed when the will is challenged, heirs disagree on who should serve as personal representative, or the court must rule on a specific dispute. Both types follow Minnesota Statutes Chapter 524, which sets out all the rules for estate administration in Minnesota.
If the estate qualifies as small, there may be no need to open probate at all. Under Minnesota Statute 524.3-1201, if total personal property is under $75,000, there is no real estate, and at least 30 days have passed since death, an heir can collect assets using the small estate affidavit (PRO201/202). Creditors have four months from published notice, or one year from the date of death, to file claims under Minnesota Statute 524.3-803.
