What Goodhue County Probate Records Contain

Probate records in Goodhue County document how property passes to heirs after death and how the court oversees people who need help with their own affairs. A standard estate file contains the petition, the will (if one was filed), notices to heirs and creditors, an inventory of assets, creditor claims, accountings by the personal representative, and the final court order. Letters of authority are also part of the file.

Guardianship and conservatorship files include the original petition, medical evaluations or assessor reports, the court's appointment order, and annual reports. These cases involve adults or minors who need a court-appointed person to manage their finances, health care, or both. Determination of descent cases, which settle inheritance questions without a full probate, are also kept in the probate division.

Since Goodhue County's probate records go back to 1854, the older files can be valuable for genealogy research and historical estate research. For records older than what MCRO holds, contact the court or the Minnesota Historical Society, which holds historical probate materials from many Minnesota counties through the mid-1980s.

Starting Probate in Goodhue County

When someone dies with property in Goodhue County, heirs typically need to open a probate case at the district court. Informal probate is the most common path. No hearing is required. The personal representative files the petition and supporting documents, and the court issues letters of authority. This works when there is no will contest and no major disagreements among heirs.

Formal probate requires at least one hearing and is needed when there is a disputed will, heirs cannot agree on who serves, or the court must rule on a specific issue. Both types follow Minnesota Statutes Chapter 524.

For estates under $75,000 in personal property with no real estate and at least 30 days since death, heirs may use the small estate affidavit (PRO201/202) under Minnesota Statute 524.3-1201. Creditors have four months from notice publication, or one year from death, to file claims under Minnesota Statute 524.3-803. Probate must start within three years of death under Minnesota Statute 524.3-108. Use the probate help page and forms library to get started.
