Finding Hubbard County Probate Records

Start your search at Minnesota Court Records Online (MCRO). This free tool lets anyone search by name or case number. Choosing "Probate or Mental Health" as the case type filters the results to estate and guardianship cases only. MCRO gives full document access for cases filed on or after July 1, 2015. For cases filed between 2005 and 2015, only orders and judgments appear, not the full file.

For older records, call the court at (218) 732-5286 or (218) 732-0137. Staff can look up what is available and explain the request process. Visiting in person is also an option. Bring the full name of the person involved and any approximate dates. Uncertified copies are free. Certified copies run $14 each.

Mail requests are accepted. Contact the court before mailing to confirm the process and any fees. Include the case name or number, a description of the records you need, and a check for any applicable fees.

Hubbard County Probate Record Contents

A probate file in Hubbard County contains the legal paperwork that documents how a deceased person's estate was handled. The standard documents in an estate file include the petition to open the estate, the will if one exists, a notice to creditors, an inventory of the deceased's assets, creditor claims filed during the case, accountings from the personal representative, and the final court order closing the estate. Letters of authority, which give the personal representative legal power to act on behalf of the estate, are also part of the file.

Guardianship and conservatorship case files work differently. They document the ongoing court supervision of someone who cannot manage their own finances or health care decisions. These files have the petition, medical evaluations, the court's appointment order, and annual reports filed by the appointed guardian or conservator. Determination of descent filings, which confirm who inherits real or personal property without opening a full probate, are also kept in the probate division and searchable in MCRO.

Not every document in a file is public. Courts seal sensitive materials, including detailed medical information and some financial records. If a document you expect to find is missing from MCRO, ask the clerk whether it is sealed and what process allows access to it.

The Probate Process in Hubbard County

When a Hubbard County resident dies with property in their name, that property usually needs to pass through probate before it can be transferred to heirs. Informal probate is available when the estate is straightforward and heirs agree on who should serve as personal representative. No court hearing is required. The personal representative files the papers, and the court issues letters of authority to allow the estate to be managed and closed.

Formal probate requires at least one hearing before a judge. It is used when the will is contested, heirs disagree, or the court needs to make a decision on a dispute. Minnesota Statutes Chapter 524 governs both informal and formal probate in the state.

Small estates may avoid probate entirely. Under Minnesota Statute 524.3-1201, if total personal property is under $75,000, there is no real estate, and at least 30 days have passed since death, an heir can use the small estate affidavit (PRO201/202) to collect assets. Creditors have four months from the published notice, or one year from the date of death, to file claims under Minnesota Statute 524.3-803. Probate must generally start within three years of death per Minnesota Statute 524.3-108. See the Minnesota probate help page and probate forms library to get started.
