Free public parking is available in the surface lot and on the street near the courthouse.
Hours run Monday through Friday, 8:00 a.m. to 4:30 p.m. The court is closed on state and federal holidays. If you plan to visit in person to request files or drop off forms, arriving before 4:00 p.m. gives staff enough time to process your request the same day. The court posts its weekly public calendar in searchable PDF format, updated hourly after 7:00 a.m. each business day.

What Cass County Probate Records Contain
Probate is the legal process used to transfer a deceased person's property to heirs after death. The court opens a case, appoints a personal representative, and oversees the collection of assets, payment of debts, and distribution of what remains. Cass County probate court records document this entire process from start to finish.
Common documents in a Cass County probate file include the original will or codicil, petition for probate or administration, inventory of estate assets, creditor claims filed against the estate, accountings submitted by the personal representative, and the final order of distribution. Guardianship and conservatorship cases are also handled here. These records document who is appointed to manage the affairs of a person who can no longer care for themselves, what assets are involved, and what the court ordered.

How to Search Cass County Probate Cases Online
The fastest way to find a Cass County probate case is through Minnesota Court Records Online (MCRO). This free portal lets you search by name or case number. When you run a name search, use the additional search options to filter by case type and select "Probate or Mental Health" so you are not sorting through unrelated results. MCRO shows documents filed in 2015 and later. It does not display all case files, but it does show what has been publicly filed.
For cases filed before 2015, you need to contact the Cass County court administration office directly. Staff can pull older paper files and let you know what is available. Some very old records from the early 1900s may also be found through the Minnesota Historical Society probate research guide.

Filing Fees for Cass County Probate Cases
The Cass County District Court charges a first paper filing fee for estate, trust, guardianship, and conservatorship cases. This fee is set at $320 (base fee of $310 plus a $10 law library fee). If you are depositing a will for safekeeping without opening an estate, the fee is $27.
Certified copies of any document cost $14 each. Uncertified copies are free. If you need to file a motion or respond to one in a probate matter, expect a $100 motion filing fee. The court does not accept payments at the service counter after 2:30 p.m. on the last business day of the month, so plan accordingly if you are paying fees near month end.
For situations where an estate is small, there may be a way to skip formal probate. Under Minnesota Statute 524.3-1201, if the estate has less than $75,000 in personal property and no real estate, and at least 30 days have passed since death, heirs can use an affidavit to collect assets without court involvement. The small estate affidavit form packet is available at no charge from the court or online.
The Cass County Probate Court Process
The court offers two main tracks for probate in Cass County: informal and formal. Informal probate does not require a hearing. A court registrar reviews the petition and, if everything is in order, appoints the personal representative without scheduling a court date. This is faster and works well when there is a clear will and no disputes among heirs.
Formal probate requires at least one hearing before a judge. You would go this route if there is a dispute about the will, if the estate is complex, if heirs disagree, or if the court requires oversight of how assets are managed. The personal representative still collects assets and pays debts, but does so under closer court supervision. Both processes are governed by the Minnesota Uniform Probate Code (Chapter 524).
One key rule to know: under Section 524.3-108, most probate proceedings must be started within three years of the date of death. After that window closes, the estate generally cannot be probated. Creditor claims must also be filed within four months of the published notice to creditors, or within one year of the date of death, under Section 524.3-803.
