Pine County Probate Records Content

A Pine County probate estate file generally includes the petition or informal application to open the estate, any will filed at the time, creditor notice documentation, and all claims submitted by creditors during the statutory window. The personal representative files an inventory of estate assets after being appointed. As the case moves forward, accountings and reports are added to the file. A final account, proposed distribution, and closing order or decree round out the record at the end of the case.

Guardianship and conservatorship records document the ongoing oversight of a person who has been appointed to manage another person's affairs. These files include the original petition, supporting medical or evaluator reports, the court's appointment order, and annual reports from the guardian or conservator. The file grows over time as the case remains open.

Trust cases, will deposit records, and determination of descent filings are also part of the probate court's jurisdiction. A determination of descent is used to legally establish who inherits property when no probate was opened, which often comes up with older real estate that has sat in a deceased person's name for years.

Note: Certain sensitive documents within probate files may be restricted from public view. Ask court staff what is accessible in any specific case you are researching.

Pine County Probate Filing Fees

Pine County's first paper filing fee for opening an estate, trust, guardianship, or conservatorship is $325. That reflects the $310 state base fee plus a $15 law library surcharge, which is among the higher law library additions in Minnesota. Depositing a will for safekeeping without starting a full probate costs $27. Filing a motion in an already open case is $100. Certified copies are $14 each. Uncertified copies are free.

Confirm current fees before filing. Fee amounts are set by the legislature and can change. Ask the clerk in Pine City about fee waiver applications if you cannot afford the filing cost. The court has a process for people who qualify based on financial need.

Filing a Probate Case in Pine County

Informal probate is the usual starting point for Pine County estates. No court hearing is required. The personal representative files the application, any will, and supporting documents with the court clerk. The court then issues letters of authority without scheduling a hearing. This path is available when there is no will contest and all parties agree on who should serve as personal representative.

Formal probate requires a court hearing and is used when there is a dispute about the will, conflict over the personal representative, or legal issues that need a judge to decide. Both routes are controlled by Minnesota Statutes Chapter 524. The Tenth Judicial District follows this statute along with local procedural rules. All forms are at the Minnesota probate forms library and the Tenth District forms guide linked above. The Minnesota probate help page provides step-by-step guidance for new filers.

If the estate has personal property under $75,000 and no real estate, and 30 or more days have passed since death, heirs may use the small estate affidavit (PRO201/202) under Minnesota Statute 524.3-1201 to collect assets without a court proceeding. Creditor claims must be filed within four months of published notice or one year from death under Minnesota Statute 524.3-803. Probate must start within three years of death under Minnesota Statute 524.3-108.
